Senator Takubo moved to amend the amendment on page fifteen, section ten, lines three and four, by striking out all of subdivision (1) and inserting in lieu thereof a new subdivision, designated subdivision (1), to read as follows:

(1)  The creation of a private office of one or more licensed health professionals to practice in this state pursuant to chapter thirty of this code.  This shall include the purchase of diagnostic imaging equipment for use solely in the licensed health professionals practice and surgical procedures that do not require an overnight hospital stay and is relative to the patients of the health professional:   Provided, That the health professional would be required to see eighty five percent of their patients in their private office to be eligible to purchase diagnostic imaging equipment and perform surgical procedures in  their private office pursuant to this exemption.
